Terms of Service
1. Introduction & Acceptance
These Terms of Service ("Terms") govern your access to and use of the JobDrop mobile application, services, and associated websites (collectively, the "Service"), operated by JobDrop ("we", "us", or "our").
By creating an account, downloading JobDrop, signing in via Apple, Google, or our portal, or activating call forwarding, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.
2. Service Description
JobDrop is a telecommunications workflow automation tool engineered for Australian tradespeople, contractors, and field service professionals. Key functionality includes:
- Carrier Call Forwarding: Intercepting unanswered or declined calls diverted via standard carrier conditional forwarding codes (*004*).
- Automated AI Lead Recovery: Immediately firing an SMS questionnaire to the caller to request their suburb, issue description, and job photos.
- VIP Whitelist Filtering: Allowing users to designate specific telephone numbers (e.g., family, suppliers, existing builders) that are suppressed from receiving automated SMS responses.
- 1-Tap Quote & Dispatch: Enabling tradies to dispatch fixed estimates or booking windows directly from the app.
3. 3-Day Free Trial & Subscriptions
We provide new eligible users with a 3-Day Free Trial to experience missed-call lead recovery in real conditions.
- Zero Risk Activation: For first-time devices with verified contact parameters, zero charges ($0.00) are made upon starting your trial.
- Fair Fraud Prevention: We employ device fingerprinting and reputation scoring to deter repeated trial abuse. If a device has previously exhausted a trial, card pre-authorization may be required.
- Billing Plans: Following your trial, access continues via your selected plan (Monthly Pro at $99/month or Annual Pro at $990/year), billed in Australian Dollars (AUD).
4. Australian Consumer Law (ACL) & Cancellation Policy
Our goods and services come with guarantees that cannot be excluded under Schedule 2 of the Competition and Consumer Act 2010 (Australian Consumer Law).
- 1-Tap Instant Cancellation: You can cancel your subscription at any time directly in the JobDrop app under Settings → Cancel Subscription.
- Fair Cycle Access Guarantee: When you cancel, you retain 100% full, uninterrupted access to your dedicated Australian number, lead backup, and AI assistant until the conclusion of your current billing period. You will never be billed again after cancellation.
5. Telephony & Carrier Divert (*004*)
You acknowledge that standard carrier conditional forwarding (*004*) is provided by your cellular carrier (Telstra, Optus, Vodafone, etc.). While JobDrop configures standard GSM divert strings, carrier network availability and local signal conditions are beyond our direct control.
Carrier Forwarding Deactivation (##004#): Upon cancellation, expiration of a trial, or termination of your subscription, it is the subscriber's sole responsibility to disable carrier conditional call forwarding by dialing standard GSM code ##004# on their mobile device. JobDrop bears zero liability for missed calls, redirected communications, lost business opportunities, or carrier forwarding remaining active post-cancellation.
6. Acceptable Use & Spam Act Compliance
JobDrop is designed strictly to facilitate responsive customer communications with individuals who have actively phoned your business. You agree not to use JobDrop for:
- Unsolicited commercial marketing (Spam Act 2003 compliance).
- Harassment, deceptive conduct, or unlawful interception.
- Operating unlicensed or fraudulent emergency services.
7. Account Deletion & Apple Guideline 5.1.1
In accordance with Apple App Store Review Guidelines Section 5.1.1 and the Australian Privacy Act 1988, you can permanently wipe your account and all associated customer lead records at any time directly in Settings → Delete Account & Data. Once triggered, all database records, lead histories, and credentials are permanently purged.
8. Intellectual Property & Proprietary Rights
All software, source code, mobile interfaces, visual designs, audio-visual assets, proprietary AI prompt engineering templates, telephony algorithms, database schemas, and documentation comprising JobDrop™ (including the JobDrop name, logo, and brand marks) are the exclusive intellectual property of JobDrop and its founders, protected under the Copyright Act 1968 (Cth), trademark common law, and international intellectual property treaties.
Users are granted a personal, non-exclusive, non-transferable, revocable license to access and use the Service strictly for legitimate business operations. You agree that you will not, directly or indirectly: (a) copy, modify, distribute, or create derivative works of any portion of the Service; (b) reverse engineer, decompile, disassemble, or attempt to extract source code, algorithms, or telephony routing logic; (c) resell, sublicense, or white-label the Service without express written consent; or (d) scrape or harvest automated communications data.
9. Limitation of Liability
To the maximum extent permitted by Australian law, JobDrop shall not be liable for any indirect, incidental, or consequential damages resulting from carrier network outages, missed job opportunities, failure by the user to execute ##004# deactivation, or inaccurate job site photos submitted by end-customers. In all cases, JobDrop's total aggregate liability shall be strictly limited to the subscription fees paid by the user in the preceding 30 days.
